To the Surrogate's Court of the Count of Chenango:
The Petition of DREW FERNALLD of the town of McDonough, County of Chenango, and the State of New York, respectfully shows:

That MARCENUS M. ELWOOD, late of the town of McDonough, County of Chenango, died on the 10th day of February, 1898, at the town of McDonough, in the County of Chenango, and State of New York, leaving a Last Will and Testament, dated the Ninth day of October, 1897, which Will is signed at teh end therof, by the said Testator and also by MERRETT M. LEWIS and L. P. BLAIR, as subscribing witnesses thereto.

That the said decedent was at the time of his death a resident of the town of McDonough, County of Chenango and State of New York. That, as your Petitioner is informed and believes, the following named persons are the only heirs at law and next of kin of said decedent, and their relationship to said decedent, and their respective places of residence and postoffice addresses are as set opposite their names respectfully, as follows:

I, WILSON M. ELWOOD of the town of Pitcher in Chenango Co. State of New York bieng of sound mind and memory do make ordain publish and declare this to be my last Will and Testament that is to say:

First-After all my lawful debts are paid and discharged, I give and bequeath to my wife OLIVE ELWOOD as long as she remain my widow, the use of all my real estate and personal estate.

Second-I give devise and bequeath to my daughters Mrs. ALICE BENNETT and CARRIE B. ELWOOD all of my real and personal estate to take effect at the death or marriage of my widow Olive Elwood.

Third-To my sons WILLIAM P. ELWOOD and DOTT H. ELWOOD I have advanced them full share.

Likewise I make constitute and appoint FRANK P. HAKES to be sole Executor of this my last Will and Testament hearby revoking all former Wills by me made.

In witness whereof, I have hereunto subscribed my name and affixed my seal, the 15th day of June in the year of our Lord one thousand eight hundred and ninety-two.
